Judge rules on behalf of boy injured at birth

Injuries at birth can disappear -- like a bruise som. However, some can last forever. A lack of oxygen during birth can result in cerebral palsy, which is a condition affecting the central nervous system for a person's entire life. More subtle issues can also span a lifetime.

When doctors and hospitals in Illinois are the reason that injuries happened in the first place, a claim for financial damages can help pay for needed medical care and accommodations for a child -- perhaps into adulthood if necessary. Parents always want the best possible lives for their children, and these claims can help them make that possible.

A mother recently won a suit against the government on behalf of her son, who was born in a federal-supported clinic in Christopher, Illinois. The boy had his shoulders stuck in his mother's birth canal for nine minutes during delivery, resulting in an injury to a bundle of nerves called the brachial plexus.

This injury has cost the boy, now five years old, permanent use of his right arm. His mother claimed she suffered negligent care because she was not given the Cesarean section she requested, which would have avoided the birth canal.

"No matter how adapted or otherwise-happy [the boy] is, for the rest of his life he will live with a right arm that is not normal," wrote the Illinois district judged who awarded the family more than $8 million.

Parents of children injured at birth have the right to sue the responsible parties if liability can be shown or is admitted. An attorney can help advise families going through the difficulties of managing birth injuries.
