Common reasons for a workers’ compensation claim denial

If you're injured on the job, you hope to make a full recovery so you can eventually return to work. You also hope to receive workers' compensation benefits during your recovery.

Even if you're entitled to these benefits, there's no guarantee that the process will unfold as planned. There are many potential reasons for a workers' compensation denial, including the following:

  • The claim wasn't filed in time: Don't hesitate to file a workers' compensation claim, as you don't want to miss the deadline. Do this as soon as your health allows.
  • The injury wasn't reported in time: Don't leave the scene of the accident until you first notify your employer. If you're unable to do so, ask a coworker to step in for you.
  • The employer disputes the claim: This is most common if your employer believes that you were injured away from work as opposed to on the job.
  • There was no medical treatment: Even if you think you're okay, it's better to be safe than sorry. If you don't receive treatment after your accident, it'll make it more difficult to fight for the compensation you deserve.

If you're injured on the job, you have every right to file a workers' comp claim. Doing so will provide a bit of financial assistance as you recover.

If your claim is denied, learn more about your legal rights and how to appeal the decision. This can be a confusing and lengthy process, but you don't want to give up. If there's money due to you, it's important to fight to receive the compensation you deserve.

John J. Hopkins: From Working Iron To
Representing Those Who Work

ALTON —Like any successful trial lawyer, John Hopkins knows the importance of preparation. But he usually doesn’t write out the questions he plans to ask witnesses in depositions or in court.

View Article “I like to react to what the witness is saying—not only what they’re saying, but how they’re saying it,” Hopkins says.
