Parents claim negligence caused baby's serious birth injuries

The birth of a child is eagerly anticipated. However, while these are joyous events for most; unfortunately, there are circumstances when things do not go as planned and a cherished child suffers serious birth injuries. Illinois families who have lived through this terrible ordeal may have recourse to seek justice and compensation.

One couple recently filed a civil lawsuit against both the obstetrician and the medical facility where he practiced. The claim alleges that the physician failed to follow proper medical protocol. He is alleged to have attempted the delivery of a baby using a vacuum apparatus device ahead of the stipulated time frame. The parents claim that just one hour into the active delivery phase, the doctor applied the suction device to the head of the unborn infant for several minutes while applying pressure to the head on three attempts.

According to the suit, the child was not in the proper position for a safe delivery or use of the device. The mother then had to undergo a cesarean section to delivery the child. Approximately 30 hours post-delivery, the infant began to suffer seizures. The couple later sought treatment for the child at a separate facility where physicians diagnosed severe brain hemorrhaging.

The child has since been diagnosed with both epilepsy and cerebral palsy. She also suffers from prolonged seizure activity as a result of the birth injuries. The parents have turned to the civil court system in an effort to seek relief from the enormous medical expenses that are required to care for their daughter for the rest of her life as well as recompense for the pain and suffering their family has endured. Illinois families who believe that the actions or negligence on the part of a physician has resulted in their child suffering irreparable harm may choose to pursue similar litigation against the parties deemed responsible for their child's injuries.
