Did a medical mistake cause a brachial plexus injury to your baby?

It is normal for the months leading up to the birth of a child to be nerve-wracking. Whether you are about to become a parent for the first time, or the fifth time, there are always some fears when it comes to delivery. To try to combat these fears, parents often put their full and complete trust in their delivery team. This is why it's particularly heartbreaking when this medical team makes a mistake that leads to a birth injury.

In this post, we are going to focus on brachial plexus injuries. Most likely, this is a medical term you never heard of before, but now are wondering just what this means and what you should do next.

What is brachial plexus?

According to the American Society for Surgery of the Hand, the brachial plexus is a network of nerves between the shoulder and neck. The nerves extend throughout the forearm, hand and arm. During delivery, pulling or stretching of these nerves can lead to injury. In some cases, it can even lead to permanent disability.

What are the signs and symptoms?

What is particularly frightening for parents is that there may not always be immediate visible signs of a brachial plexus injury. However, later on - you may start to realize that something does not seem right, as the baby is exhibiting a lack of reflexes in their arm or general weakness. This could be one of the first signs that it is also time to call an attorney.

How an attorney can help

Parents and parents-to-be put their full and complete trust in medical professionals to safely delivery a baby. And while there are certainly cases where things do not go as planned, these professionals should always be weighing the risks and acting in a way that puts the health of the mother and baby first. In cases where this does not happen, these same professionals need to be held accountable for their actions, or lack thereof.

Birth injuries are especially traumatic. There is a lot of emotion when it comes to the possibility of a life-long disability. At the Law firm of John J. Hopkins & Associates, we protect the rights of our clients. We understand how life-altering birth injuries are. Our goal is to get our clients the compensation they deserve, while also giving them the time they need to emotionally heal from their ordeal.

John J. Hopkins: From Working Iron To
Representing Those Who Work

ALTON —Like any successful trial lawyer, John Hopkins knows the importance of preparation. But he usually doesn’t write out the questions he plans to ask witnesses in depositions or in court.

View Article “I like to react to what the witness is saying—not only what they’re saying, but how they’re saying it,” Hopkins says.
